Welcome to InstrumentReport, a service operated by Sacramento Labs LLC (“we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of InstrumentReport (“the Service”). By creating an account, accessing the site, or using the Service, you agree to these Terms in full. If you do not agree, do not use the Service.

1. Eligibility
InstrumentReport is available to users aged 18 or older and may be accessed worldwide where legally permitted. You are solely responsible for ensuring your use complies with applicable local laws.
2. Accounts and Access
You must create an account using a valid email and password. Each account is intended for one individual. You may not share your login credentials or allow others to access your account.
We may suspend or terminate accounts suspected of being shared across multiple individuals.
3. Subscriptions and Billing
InstrumentReport operates under a subscription-based model, with pricing tiers shown on our public [Pricing Page].

Subscriptions may be billed monthly or annually, as selected during sign-up.

No free trials are offered. Example reports may be viewed for free to evaluate the Service.

Refunds may be issued at our sole discretion.

You may cancel your subscription at any time; access continues through the paid period. No partial refunds are provided.

We reserve the right to change pricing or features with prior notice.
Usage limits, if any, will be posted publicly on our pricing page.
4. Permitted Use
You may use the Service to:

Upload images and descriptions of musical instruments or audio gear.

Generate reports for personal use or internal business purposes (e.g., for collectors, dealers, or resellers evaluating their own gear).
You may not:

Sell, sublicense, republish, or redistribute InstrumentReport reports or outputs.

Generate reports for third parties as part of a commercial service (e.g., valuation consulting).

Upload non-relevant images or data (e.g., people, personal documents, non-gear photos).

Circumvent usage limits or reverse-engineer our systems.

Use the Service where prohibited by law.

5. Uploaded Content and Licensing
By uploading content, you represent that:

It does not contain personal, sensitive, or copyrighted material unless you own or control the rights.
You grant Sacramento Labs LLC a non-exclusive, worldwide, royalty-free, perpetual license to:

Use, reproduce, modify, distribute, and display your uploaded content within InstrumentReport and related marketing or educational materials.
This license survives account closure and cannot be revoked retroactively. We may, at our discretion, remove specific content upon request, but are not obligated to do so.
6. Report Accuracy and Limitations
InstrumentReport uses AI and market data to generate real-time valuation reports. These reports are for informational purposes only and may include inaccuracies.
We make no guarantees about:

The correctness or completeness of any valuation

The precise identification of model, year, or maker

The suitability of reports for legal, tax, insurance, estate, or court purposes
You are solely responsible for verifying findings and deciding how to act on them. Sacramento Labs LLC is not liable for any financial loss, missed opportunity, or reputational harm resulting from your use of the Service.
7. Service Availability and Changes
We aim to provide continuous, high-quality access to InstrumentReport, but:

If your account is terminated for cause, you will not receive a refund and may lose access to uploaded content and past reports.
10. Indemnification
You agree to indemnify and hold harmless Sacramento Labs LLC, its officers, employees, affiliates, and agents from any claims, damages, losses, or expenses (including attorney fees) arising from:

11. Limitation of Liability

All reports are used at your own risk.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
All disputes shall be resolved by binding arbitration in Sacramento, California, under the rules of the American Arbitration Association. You waive the right to jury trial and class action participation.
13. Force Majeure
We are not responsible for delays or failure to provide the Service due to events beyond our control, including natural disasters, service outages, government orders, or cyberattacks.
14. Changes to These Terms
We may revise these Terms at any time. If we make material changes, we will notify users via email or website banner. Continued use of the Service after updates constitutes acceptance of the revised Terms.
